Copyright claims on videos - conditions?

Does anyone know the answers to these questions?

Is there any difference between whether copyright claims are enforced on private vs unlisted vs public videos?

How are there so many unofficial music video channels that seem to go along no problem, but using a brief section of movie or video clip or a piece of music in a YT video on another subject is often hit really quickly with a claim or strike?

Sorry I just saw this.

I believe all of them are enforced. Because at any given time you could turn a private into a public video.

Now mind you, if the song is on a private video, the chances of any skeezy or legitimate music company seeing it is zero (no one can see those videos but you). Unlisted has a decent chance of sliding through, but Public... If there is a computer attached to any scumbag or music scanning program, it will try and nab you, IMO.
